Court to hear appeal in $28.8 mln lawsuit against Radio Frequency Commission

MOSCOW, November 24 - RAPSI, Natalia Belova. A court will hear on December 15 a cassation appeal against the adverse judgment over a $28.8 million lawsuit filed against the State Radio Frequency Commission, the court told the Russian Legal Information Agency (RAPSI) on Thursday.

The Moscow Commercial Court has held against Saturn, Modul and StroyResurs on June 15 in their claims against the State Radio Frequency Commission and the Communications and Mass Media Ministry. The decision came into force in September after the appeals court upheld it. The claimants then challenged the judgments in the cassation court.

The companies demanded radio-frequency bands to set radio communications and data transmission channels for a number of Russian regions.

Each of the claimants also sought to recover 300 million rubles ($9.6 million) in compensation for losses they sustained after the Commission failed to consider their applications for frequency bands.

The companies told the court that they filed the applications in February 2008, but the Commission did not consider them. However, the defendants objected the statements saying that the claimants failed to prove their losses.
