State Duma to discuss procedure for IP Court

MOSCOW, April 3 - RAPSI. State Duma Deputy Pavel Krasheninnikov from the United Russia party has submitted a package of proposals aimed at the development of the Intellectual Property Court in Russia, the lower house told RIA Novosti on Wednesday.

In December 2011, then-President Dmitry Medvedev signed amendments to the constitutional laws "On the Judicial System" and "On Commercial Courts," aimed at establishing the IP Court as part of the commercial court system.

The list of disputes included in the competence of the IP Court will be expanded to include cases involving compensation for violations of a plaintiff's right to judicial proceedings in a reasonable period of time, Krasheninnikov said.

This concerns cases considered either by the IP Court as a first instance court, or by commercial courts for intellectual rights disputes.

Meanwhile, lawsuits seeking to prematurely annul the legal protection of brands in Russia that are not being used will be exempted from the court's competence.

Krasheninnikov heads the State Duma Committee on Civil, Criminal, Commercial and Procedural Legislation.
